Terms of Service

1. Description of the Service

FastCODX is an automated professional website creation service. The Customer provides business information through an online form, and FastCODX generates, deploys, and delivers a customized website using artificial intelligence and pre-built templates.

The Service includes:

• Automated website generation based on Customer-provided data
• Website hosting on a preview subdomain (preview.fastcodx.com)
• Responsive design (mobile and desktop)
• Basic SEO configuration
• Contact form functionality
• Features selected during the ordering process

2. Ordering Process

1. The Customer completes the multi-step form providing business information, preferences, and visual style choices.
2. The Customer reviews a preview of the website design.
3. The Customer completes payment through Stripe, our third-party payment processor.
4. FastCODX generates and deploys the website, typically within 2 hours.
5. The Customer receives an email notification with a link to the live website.

By completing payment, the Customer acknowledges and agrees that delivery of the Service begins immediately.

3. Pricing and Payment

All prices are displayed in the currency applicable to your region (EUR, USD, or other supported currencies). As CODX, LLC is a US-based company, prices do not include VAT. Customers in jurisdictions that require VAT or sales tax may be subject to additional charges at checkout, which will be clearly displayed before payment.

The final price is calculated based on the type of website selected and any optional add-ons chosen during the ordering process. The price is clearly displayed before payment is confirmed.

Payment is processed securely by Stripe, Inc. We do not store credit card numbers or sensitive payment data on our servers.

4. Delivery

The estimated delivery time is less than 2 hours from payment confirmation. This is an estimate, not a guarantee. In the event of technical delays, we will notify the Customer by email.

Delivery is considered complete when the website is deployed and accessible via the preview URL, and the delivery notification email has been sent to the Customer's provided email address.

5. Post-Delivery Modifications

Included modifications: One (1) round of minor changes is included at no additional cost within seven (7) calendar days of delivery. Minor changes include: text corrections, photo replacements, color adjustments, and contact information updates.

Major changes: Structural modifications, website type changes, addition of new sections, or significant redesigns are not included and will be quoted separately upon request.

Self-service editing: When available, the Customer may use the self-service editor in their dashboard to make changes to texts, photos, and colors at any time.

6. Hosting and Availability

Website hosting is included at no additional cost for a minimum period of one (1) year from the date of delivery. After this initial period, hosting terms may be subject to change, including the potential introduction of a maintenance or hosting fee. Any changes to hosting terms will be communicated at least sixty (60) days in advance via email.

We use industry-standard infrastructure providers (Cloudflare, Inc.) to ensure high availability and performance. We do not guarantee 100% uptime but make commercially reasonable efforts to maintain continuous availability. We are not liable for downtime caused by our infrastructure providers, force majeure events, or circumstances beyond our reasonable control.

In the event that FastCODX ceases operations, we will provide Customers with at least ninety (90) days' prior written notice to the email address on file.

7. Custom Domain

Domain registration and configuration is available as an optional service at an additional annual cost. If the Customer already owns a domain, we can configure it to point to the hosted website.

Domain registration fees are non-refundable and are subject to third-party registrar terms and conditions.

8. Intellectual Property

Customer content: The Customer retains all rights to the content they provide (original text, photographs, logos, and other materials). The Customer represents and warrants that they have the necessary rights to use all content provided.

AI-generated content: Texts, descriptions, and other content generated by artificial intelligence as part of the Service become the property of the Customer upon completed payment.

Platform and templates: The source code, templates, design system, software infrastructure, and all underlying technology of the FastCODX platform are and remain the exclusive property of CODX, LLC. No license to the platform code is granted to the Customer.

FastCODX branding: Generated websites include a "Made with FastCODX" badge in the footer. This badge may not be removed under the standard service tier.

9. Acceptable Use

The Customer agrees not to use the Service to create websites that:

• Contain illegal, fraudulent, defamatory, or harmful content
• Infringe upon the intellectual property rights of third parties
• Promote violence, discrimination, or hate speech
• Distribute malware, spam, or engage in phishing
• Violate any applicable law or regulation

We reserve the right to refuse service, suspend, or remove any website that violates these terms without prior notice and without refund.

10. Refund Policy

Refund requests must be submitted within thirty (30) calendar days of the payment date by contacting us at hola@fastcodx.com.

Approved refunds will be processed through Stripe to the original payment method within 5-10 business days.

11. Right of Withdrawal (EU/EEA Customers)

Under the EU Consumer Rights Directive (2011/83/EU), consumers have a 14-day right of withdrawal for online purchases. However, in accordance with Article 16(a) of the Directive, this right does not apply to the supply of digital content or services where performance has begun with the consumer's prior express consent and acknowledgment that the right of withdrawal is lost.

By completing payment, the Customer expressly consents to the immediate commencement of the Service and acknowledges the loss of the right of withdrawal once the website has been delivered.

If the Customer requests cancellation before the website is completed and delivered, a full refund will be issued.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Company's total aggregate liability arising from or related to these Terms shall not exceed the amount paid by the Customer for the specific Service giving rise to the claim.
• The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
• The Company is not liable for the content provided by the Customer, the accuracy of AI-generated content, search engine rankings, or business results obtained through the website.

13. Indemnification

The Customer agrees to indemnify and hold harmless CODX, LLC, its officers, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) the Customer's use of the Service; (b) content provided by the Customer; (c) the Customer's violation of these Terms; or (d) the Customer's violation of any applicable law or third-party rights.

14. Third-Party Services

The Service integrates with third-party providers including but not limited to Stripe (payments), Cloudflare (hosting), Supabase (data storage), and Resend (email delivery). Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, performance, or policies of third-party services.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to existing Customers at least thirty (30) days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

16. Governing Law and Dispute Resolution

For EU/EEA Customers: These Terms are governed by the laws of your country of residence. You may bring claims in the courts of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/odr.

For all other Customers: These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

17. Age Requirement

You must be at least sixteen (16) years of age to use the Service. By placing an order, you represent that you meet this age requirement.

18. Marketing Communications

With your explicit consent, we may send you marketing communications about new features, offers, or related services. You can unsubscribe at any time by clicking the unsubscribe link in any marketing email, or by contacting us. Transactional emails (order confirmations, delivery notifications, service updates) are not considered marketing and will be sent regardless of your marketing preferences.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
